OF THE CITY OF HERMOSA BEACH HELD ON
SEPTEMBER 20, 2005, 7:00 P.M.,

6.     CUP 05-8 -- Conditional Use Permit amendment for a restaurant with on-sale alcohol to change the closing time from 12:00 midnight to 2:00 A.M. daily at 73 Pier Avenue, Mediterraneo.(PDF File).

Staff Recommended Action: To direct staff as deemed appropriate.

Senior Planner Robertson advised that the Mediterraneo restaurant is located on the north side of Pier Plaza, the former location of Brewski’s; and noted that it has been operating as Mediterraneo, a sit-down restaurant, since early 2004. When the Planning Commission approved this conditional use permit (CUP) in October 2003, he noted that the hours were limited to 2:00 A.M. and that live entertainment would cease at 1:15 A.M.; however, he advised that in December 2003, City Council sustained the Planning Commission’s decision to allow on-sale alcohol, but imposed a more restrictive closing time of midnight. He stated that the applicant is now seeking authorization to close at the 2:00 A.M. hour, as previously recommended by the Planning Commission; and pointed out that this is the only change being requested this evening. Senior Planner Robertson explained that the midnight restriction was based, in part, on Council’s feelings that an upscale, sit-down restaurant did not need later hours – believing it would create more of a bar or nightclub atmosphere and that the business operation hours could be reviewed after six months of operation. He pointed out that since the opening of the Mediterraneo restaurant, there have been no reported problems with respect to noise or other violations with its CUP. He added that the Commission has been provided a list of the restricted hours for other restaurants on Pier Plaza, many which have bars operating from 7:00 A.M. to 2:00 A.M. He stated that staff is seeking the Commission’s direction on this proposal.

Commissioner Kersenboom recalled that the Commission’s prior concern was that this establishment not turn into another nuisance party spot.

Director Blumenfeld noted that some of the Commission’s prior deliberations pertained to whether this was going to be a sit-down restaurant that offered a full menu; noted staff’s opinion that this is a dining establishment; and pointed out that over the period of time it’s been in operation, the business has demonstrated it is a full service restaurant and has not had any Conditional Use Permit violations.

Commissioner Kersenboom questioned if the applicant is proposing any change in the seating plan or a dance floor.

Director Blumenfeld advised that a seating plan has been prepared at staff’s request and that the area layout is the same and no dance floor is being proposed.

The Commission reviewed the seating plan at this time.

Director Blumenfeld confirmed for Commissioner Perrotti that there have been no citations with this business; and explained that when the City commenced its code enforcement activity in this area at the end of last year and beginning of this year, no violations were observed.

Chairman Pizer opened the public hearing.

Albro Lundy, attorney representing the applicant, stated that two years ago, in 2003, there was an approval for a 2:00 A.M. closing hour, which was an important decision to help this business become financially viable; and stated that Mediterraneo is a European, upscale restaurant with exceptional food and wine. He advised that Tommy Short owned Brewski’s for 10 years without any issuance of a single citation; and added that two years ago, Mr. Short turned this facility into this upscale restaurant known as Mediterraneo. He stated that this restaurant needs the extended hours to financially sustain itself; advised that it’s been operating since November 2003; that the business has successfully undergone the 6-month review process; and expressed his belief that after two years of operation, this business has proven it is an enhancement to this area and the City. Mr. Lundy explained that businesses in this area make their profits after hours when the Plaza area is alive with business; and advised that they are not planning on having a bar or dance floor, but that they intend to improve the quality of Hermosa Beach and the quality of its night life. He mentioned that one of the arguments at the City Council level was to allow this restaurant to compete with the other restaurants in this area; that Council directed the midnight restriction be imposed for six months and then following with a review process; and he stated that this business has proved it can operate under the conditions imposed and he urged the City to allow this business to stay open until 2:00 A.M. daily.

Mr. Lundy noted for Commissioner Kersenboom that the CUP has a provision which states no live entertainment will be permitted, with the exception of special occasions like New Year’s Eve. He stated they would probably either have a non-amplified acoustic guitar, a trio, piano, or violin. He reiterated that there is no interest in turning this business into a bar.

Matt Houston, general manager of Mediterraneo and resident of Hermosa Beach, expressed his belief this business has proven it is an upstanding business in this community; stated that they are committed to maintaining a classic environment, with excellent food and drink; and he urged support of this request so they can continue to provide an upscale dining environment for Hermosa Beach.

Commissioner Perrotti questioned if any type of food would be served after the kitchen closes.

Mr. Houston stated that the kitchen currently closes at 11:30 P.M. and that they are interested in being able to serve food a half hour to an hour later, noting that simple cuisine will be served at the later hour, such as desserts and finger foods.

Chairman Pizer questioned if this restaurant is currently profitable.

Mr. Houston noted for Chairman Pizer that the first year was a big challenge, but that this second year, he feels they are becoming more successful, establishing much more of a regular clientele.

Chairman Pizer questioned if the applicant believes he cannot make an acceptable profit based upon the current hours of operation.

Responding to Chairman Pizer’s inquiry, Mr. Houston stated that the additional two hours of business, when Hermosa Beach is at its busiest, would create a more acceptable profit margin than what the restaurant currently enjoys.

Chairman Pizer questioned if the business is open for lunch.

Mr. Houston stated that the restaurant is open for lunch 3 days a week: Fridays, Saturdays and Sundays.

In response to Commissioner Kersenboom’s inquiry regarding the later hours, Mr. Houston explained that it is their intent to offer food at a later hour, an alternative to fast food or pizza, for instance.

Brad Adams, 5th Street resident, expressed his support of the applicant’s request, stating that this is a good, quiet place to sit down and talk with his friends while enjoying something to eat and drink.

Jim Lissner, Hermosa Beach resident, expressed his belief that a lot of restaurants have promised the same success, only to later become problem businesses in the Plaza area; stated that there are successful restaurants which do well with limited hours; and questioned whether this restaurant can improve things on Pier Avenue. He noted his opposition to adding to the concentration of alcohol licenses in this area and noted his opposition to this request.

Amber Coddle, executive chef at Mediterraneo and Hermosa Beach resident, stated that this restaurant serves great food; that the restaurant strives to maintain a quiet and relaxed atmosphere; and echoed the owner’s comments that they do not intend for this business to become a bar or club.

Mr. Lundy pointed out that this establishment already has an alcohol license, that they are only seeking the extended hours to serve food and the alcohol to go along with the food late in the evening; and advised that this establishment has continually conformed to all imposed conditions.

Shirley Castle, Hermosa Beach resident, expressed her opposition to this request; commented on the noise, litter and other nuisance problems in this area because of the late hours; and suggested that all bars/clubs in the City be closed two hours earlier.

There being no further input, Chairman Pizer closed the public hearing.

Commissioner Kersenboom expressed his belief that this establishment has proven it can abide by the conditions of approval and that it is not one of the establishments causing problems in this area.

Commissioner Perrotti highlighted his vision of the Pier Plaza becoming a restaurant row instead of what it has evolved into – more of a sports bar row; and stated that there are problems in this area, but pointed out that this establishment is not one that has caused any of the problems. He stated that when he has been on the Plaza, he has noticed there are still people in this restaurant eating later in the evening, that these people are not there only to drink alcohol; and stated that action should be taken against those establishments that have been cited for violations, not those that abide by the rules imposed by the City. He stated that this establishment should not be punished for the actions of those violating establishments; that this business should be given equal opportunity as those like businesses in this area; and suggested possibly limiting the hour to 1:00 A.M.

Vice-Chairman Hoffman stated that while there have been no problems with this establishment, he is concerned that extending the hours would change their clientele, whether they want it or not, because the people wandering around the Pier Plaza area at 1:00 A.M. or 1:30 A.M. aren’t necessarily looking for a fine dining experience, but perhaps are looking to change their drinking venue; and that this may not be something the owner, regardless of his intentions, can necessarily control. He noted his concern that if this establishment should close down, the alcohol permit would run with the property, not the establishment, thereby allowing another establishment to occupy this space with a full liquor license and a 2:00 A.M. closing time. He suggested that the owner consider amending the lunch hour; and he mentioned that financial issues are not supposed to influence the Commission’s decision.

Commissioner Allen recognized that the owner of the Mediterraneo has been an excellent citizen for Hermosa Beach and he thanked him for his past involvement with this City. He echoed Vice-Chairman Hoffman’s concerns with the potential for transference of the liquor license and late closure; and stated he would consider going with a 1:00 A.M. hour instead of 2:00 A.M.

Highlighting the concern with the potential for transference of the liquor license and closing hour, Commissioner Kersenboom suggested placing a condition upon the CUP, requiring that the establishment be reviewed every year or two; and stated that if there are violations, this would give the City leverage in pulling the CUP. He suggested that this be done with all liquor license businesses.

Chairman Pizer expressed his belief that this business has escaped problems because it has an earlier closing hour; stated that successful upscale restaurants do not need late hours to be profitable; and echoed the concerns with the potential for transference of a liquor license if this establishment fails. He added that it has been Council’s policy to be more restrictive.

MOTION by Vice-Chairman Hoffman, seconded by Commissioner Allen, to DENY CUP 05-8 -- Conditional Use Permit amendment for a restaurant with on-sale alcohol to change the closing time from 12:00 midnight to 2:00 A.M. daily at 73 Pier Avenue, Mediterraneo. The motion carried as follows:

MINUTES OF THE PLANNING COMMISSION MEETING OF THE CITY OF HERMOSA BEACH HELD ON OCTOBER 21, 2003, 7:00 P.M., AT THE CITY HALL COUNCIL CHAMBERS

  1. CUP 03-9 -- Conditional Use Permit amendment to convert a brew-pub to a full service restaurant with on sale general alcohol at 73 Pier Avenue. (PDF File)

    Staff Recommended Action: To approve said request.

    Director Blumenfeld explained that this request is to amend the original conditional use permit that was granted to Brewski's for on-sale beer and wine; stated that an application was subsequently filed and approved for the restaurant with on-sale general alcohol and live entertainment; and noted that the on-sale general alcohol portion of the permit was not put into effect. He explained that the owner is proposing a change to the format of the restaurant, changes that are appropriate to the zone and General Plan; advised that the applicant is proposing some cosmetic changes to the exterior of the building; that the interior will be altered to eliminate the micro-brewery portion of the original project; that standard table seating will be created - pointing out that the high-top tables will be eliminated; and that within this area, the restaurant will be slightly reconfigured. He noted that there would be no changes to the bar area; that wine service will be added; stated that the location of the previously identified stage for live entertainment has been eliminated; but that the owner is proposing to maintain the entertainment aspect of the conditional use permit, the intent being to have non-amplified entertainment. He expressed staff's belief that the modified proposed use is fitting for the Pier Plaza area; that it will not create additional nuisance problems; and noted that it will not increase the occupant load above the original use.

    Responding to Vice-Chairman Tucker's inquiry regarding the removal of the brewing tanks and the original Alcoholic Beverage Control (ABC) licensing, Director Blumenfeld stated that the applicant will have to reapply for their ABC license.

    Chairman Hoffman opened the public hearing.

    Albaro Lundy, representing Mediterraneo Restaurant, handed out a packet of information depicting what is being proposed.

    Commissioner Perrotti questioned the likelihood of this business becoming more of a club or bar atmosphere in the future.

    Responding to Commissioner Perrotti's concern, Mr. Lundy stated that limited food service will be available one half hour before last call; advised that the applicant has no intent of this establishment becoming a bar or dancing facility; and explained that the music most likely to take place will be a trio, singles drummer or harp player, something that will add to the elegant ambiance of the establishment. He stated that the quality of the food will make this business a success, not the entertainment.

    Charile Cheetum, 548 Second Street, expressed his belief that this business should not be permitted to obtain an on-sale general alcohol license, believing that this will allow this establishment to eventually become a bar; and asked that drinking on the patio should be prohibited after 11:00 P.M.

    Jim Lissner, resident, expressed his belief that the proposed hours of operation are appropriate for a bar, not a restaurant; and stated that this establishment should close at midnight on the weekends and 10:30 P.M. on the weekdays.

    Roberta Moore, 930 9th Street, stated that she is not opposed to bars in Hermosa Beach.

    Mr. Lundy stated that this business will raise the business standards in this area; that this business will seek to cater to the older crowd, not college aged individuals; advised that the applicant is in the process of negotiating a transfer for the full liquor license; and stated that if the transfer is refused, the applicant will carry on with the smaller brewing activities.

    There being no further input, Chairman Hoffman closed the public hearing.

    Commissioner Kersenboom noted his support for this higher end restaurant; pointed out that it already has a liquor license; and stated that he is looking forward to it opening for business.

    Vice-Chairman Tucker pointed out that the establishment already has a liquor license; commented on the City's periodic review of conditional use permits for conformance; and expressed his belief this business will be a good addition to the Downtown area.

    Commissioner Pizer expressed his belief that because of the 2:00 A.M. closing of this business, it will likely become a drinking and music establishment; stated that he would prefer not allowing the general alcohol use; and noted that in 6 months, the Planning Commission should review the operations of this business to determine how it is truly performing.

    Commissioner Perrotti expressed his belief that this is a perfect area for this type of restaurant; stated that a rowdy/nuisance business is more of an issue with poor management than it is with serving general alcohol; and stated that he would support a 6-month review of this permit.

    Chairman Hoffman expressed his belief that the location for this business is appropriate and noted the need to encourage a vital Downtown area.

    MOTION by Commissioner Perrotti, seconded by Commissioner Kersenboom, to APPROVE CUP 03-9 -- Conditional Use Permit amendment to convert a brew-pub to a full-service restaurant with on-sale general alcohol at 73 Pier Avenue. The motion carried as follows:

Councilmember Tucker left the dais after recusing himself from hearing this item since he heard it initially as a Planning Commissioner and it concerned an individual piece of property.

Community Development Director Blumenfeld presented the staff report and responded to Council questions.

The public hearing opened at 8:35 p.m. Coming forward to address the Council on this item were:

Albro Lundy
- Hermosa Beach homeowner and commercial property owner, said he was representing the Mediterraneo, a restaurant offering fine dining, not a bar; said martinis, after-dinner drinks, and other beverages would be served with tapas until 2 a.m. citing a market for late night food; said the City needed a world class restaurant for upper level clientele because property values have increased dramatically;
 
Bob Bergstrom
- Hermosa Beach, said he had seen the downtown go through many stages in the 76 years he has been a resident; said there were now too many liquor licenses and a restaurant did not need full liquor to be successful, citing the Bottle Inn;
 
Barbara Ellman
- Hermosa Beach, said the Chamber of Commerce website says that meals would be served until 9 p.m. with only hors d'oeuvres served after that; said there were too many people downtown, not enough police officers, and conditional use permits (CUP's) were not enforced;
 
Anna Button
- Hermosa Beach, said she moved into town a year and a half ago; said a high-class restaurant would bring in a better, older clientele and should be welcomed;
 
Rita Maroon
- Hermosa Beach, said she moved here three years ago from Virginia; said the City was beautiful and diverse but Pier Plaza has changed, causing her to go to Manhattan Beach, which catered more to young professionals; said this restaurant would upgrade the downtown as would the Dragon, another restaurant being proposed, and would not cause any problems;
 
Jim Lissner
- Hermosa Beach, said he had no financial connection with this restaurant and hoped that each speaker would indicate if they did; said there had been no mention of whether recorded music was allowed; thought the restaurant should close at 10:30 p.m., except on weekends, when 2 a.m. would be acceptable;
 
J. G. Wolf
- Hermosa Beach, said he lived two blocks from the location and did not want more problems on his street; said he would welcome a good restaurant that served food late, though not necessarily as late as 2 a.m.; urged the Council to place restrictions in the CUP and enforce it to keep the business a restaurant, not a nightclub;
 
Jack Janken
- Hermosa Beach, suggested that the restaurant be allowed to stay open until 2 a.m. but be required to stop serving alcohol about 11:30 p.m.;
 
Antonio Reyes
- said he came from Italy to be chef for this restaurant; which he hoped would provide not only wonderful food but also an education for the clientele regarding wine and healthy, non-fried Mediterranean food; said the restaurant would be a good addition to Hermosa Beach;
 
Brent Richert
- Hermosa Beach, said he just moved here from Washington, D.C., and looked forward to a restaurant with fine food, liquor to complement the food, and after-dinner drinks; said the community would benefit from a restaurant which encouraged good food with an atmosphere which allowed conversation to contrast the chaos at Pier Plaza;
 
Vince Tatoo
- Hermosa Beach, said CUP's should be enforced; said Manhattan Beach had similar problems which they were able to clean up; said the City Council should take a stand on improving conditions at Pier Plaza;
 
Carla Merriman
- Executive Director, Chamber of Commerce and Visitor's Bureau, said this would be an upscale restaurant catering to an older clientele, noting that the Chamber has spent $70,000 on a campaign to try to attract this type of restaurant and upscale tourism in general;
 
Gary Zimmerman
- Hermosa Beach, expressed doubt that this type of restaurant would be successful in Hermosa and thought it was unrealistic to think that one upscale restaurant would change the atmosphere at Pier Plaza;
 
Courtney Faut
- Hermosa Beach, said an upscale restaurant like this was a step in the right direction; said people should be allowed to eat at 1 a.m. and have alcohol with their food if they want;
 
Al Benson
- Hermosa Beach, said the restaurant would become a nightclub at 9 p.m., since only tapas would be served after that time; said people were not opposed to this specific restaurant but were concerned about an increase in alcohol-related crime; said the City should enforce the CUP's to improve conditions;
 
Tim Dolan
- Hermosa Beach, Hennessey's Regional Manager, said their CUP was changed for closure at 11 p.m. on weeknights and at midnight on weekends; empathized with residents who were disturbed in their neighborhoods, noting that businesses did not want their customers to cause problems;
 
Greg Newman
- Hermosa Beach, owner of Sharkeez, said this restaurant would not be a bar because it was not set up like one and did not have a bar atmosphere; agreed that the clientele at Pier Plaza could be more upscale; said he wanted to keep the young professionals in Hermosa rather than Manhattan Beach; urged the Council to give this restaurant a chance;
 
John Bowler
- Hermosa Beach, agreed that change was needed at Pier Plaza and said this upscale restaurant would contribute to improvement; encourage the Council to give the restaurant the operating hours it needed to succeed; and
 
Steven Roberts
- Hermosa Beach, owner of Cafe Boogaloo, said the City Council gave him a chance 10 years ago and he did what he promised to do; said that this restaurant deserved the same opportunity.

The public hearing closed at 9:27 p.m.

Proposed Action: To approve the staff recommendation to sustain the Planning Commission approval with the added condition that the service of alcohol stop at midnight, except for holiday exemption, with only the service of food allowed until 2 a.m.

Action: To approve the staff recommendation to adopt Resolution No. 03-6317, entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT, UPON RECONSIDERATION, AND AS AMENDED, TO ALLOW ON-SALE GENERAL ALCOHOL AND LIVE ENTERTAINMENT IN CONJUNCTION WITH A RESTAURANT AT 73 PIER AVENUE, LEGALLY DESCRIBED AS LOT 27, BLOCK 13, HERMOSA BEACH TRACT" amended to require the restaurant to close at midnight, except on New year's Eve, when it may remain open until 2 a.m.
 

Motion Yoon, second Reviczky. The motion carried, noting the dissenting vote of Edgerton and the absence of Tucker.
